Fabelt Terms of Use Privacy Shield and Intellectual Property Policies

ARTICLE 1. PARTIES

These comprehensive general terms and conditions govern the contractual relationship between Stanfield, SASU, a company with a share capital of €1000, registered with the RCS of 75001 in France on 01/03/2024 under number 985143783, with its head office located at 229 Rue Saint-Honoré, 75001 Paris, FR. These terms apply to any private or public individual or entity registered on the Site who is seeking to purchase a Product. Throughout these terms, Stanfield SASU is hereinafter referred to as “the Publisher,” and any registered user or entity browsing or utilizing the Site for purchasing products is referred to as “the Client.”

ARTICLE 2. DEFINITIONS

“Client”: Any individual or entity, whether private or public, with registered access on the Site for the purpose of purchasing Products.

“Site Content”: The entirety of elements published on the Site, including but not limited to texts, images, designs, presentations, videos, diagrams, databases, software, and structures, which may or may not be protected by intellectual property rights.

“The Publisher”: Stanfield, SASU, acting solely in its capacity as the publisher of the Site, responsible for hosting and maintaining the digital platform.

“Internet User”: Any individual or entity accessing the Site, whether or not registered, with or without the intent to purchase.

“Product”: Various goods offered for sale via the Site, encompassing physical and digital items, processed and sold by the Publisher to Clients.

“Site”: The online platform accessible at Fabelt.com, including all associated sub-sites, mirror sites, portals, and URL variations under the same domain or related domains.

ARTICLE 3. SCOPE

Access to the Site is freely available to any Internet User. By browsing, users accept these general conditions fully and unconditionally. Connecting to the Site by any means, including automation tools such as robots or crawlers, signifies acceptance of these terms. Moreover, each registration process confirms the User’s acceptance. Users affirm that they have read these conditions thoroughly and agree without restriction, recognizing that ticking the acceptance box constitutes a legally binding signature equivalent to handwritten consent. The Publisher’s automated recording systems establish evidence of this agreement, and unless proven otherwise, Users waive the right to contest such records in legal proceedings. These general terms govern the entire relationship between the parties, superseding any prior or conflicting terms from Users, who must possess the legal capacity to accept them, or secure appropriate authorization if under legal incapacity, minors, or representing legal entities.

The acceptance of these terms is a prerequisite for creating a personal space or making any purchase. It ensures that the User understands, agrees, and commits to abide by all contractual obligations and provisions governing usage of the Site.

ARTICLE 4. PURPOSE OF THE SITE

The primary objective of the Site is to facilitate the online sale of Products, enabling Clients to browse, select, and purchase items securely through digital transactions governed by these terms.

ARTICLE 6. PERSONAL SPACE

6.1. Creation of Personal Space

Establishing a personal space is essential for placing orders. To do so, Users provide selected personal information, with certain data marked as mandatory to ensure proper account creation. Refusal or failure to provide required data will hinder the ability to create this space, thereby preventing order validation. During registration, Users choose a password, which safeguards access to their personal data and transaction history. They are advised to keep this password confidential, as the Publisher cannot be held responsible for unauthorized access resulting from disclosure or negligence. Users undertake to verify, update, and maintain the accuracy of their data periodically within their personal space, facilitating seamless order processing and communication.

6.2. Content of Personal Space

This digital environment allows Clients to view, track, and manage all their orders conveniently. While these pages can be printed for personal record-keeping, they are strictly informational and do not hold legal value in court. Confidential contractual documents are stored securely by the Publisher, aligning with applicable data retention regulations and Best Practices in data management.

6.3. Deletion of Personal Space

In cases where Clients violate these terms—such as providing false data, incomplete profiles, or remaining inactive for over one year—the Publisher reserves the right to delete or deactivate accounts without prior notice. Such actions aim to maintain a secure and trustworthy platform, and they do not entail liability or compensation. The Publisher retains the right to pursue legal remedies if justified, especially in the event of fraudulent activity or data misuse.

ARTICLE 7. PERSONAL DATA

The Publisher processes personal data in compliance with applicable legislation and in accordance with its privacy policy, emphasizing transparency, data minimization, and security, with adherence to GDPR principles. This data management enhances customer experience through personalized services while safeguarding individuals’ privacy rights.
