ARTICLE 1. PURPOSE

This shipping policy aims to clearly define the terms and conditions governing the shipment of Products from the Publisher to the Client. Its goal is to ensure transparency, set expectations, and facilitate a smooth transaction process by outlining responsibilities related to delivery, costs, and risk transfer, thereby enhancing customer confidence and satisfaction.

ARTICLE 2. PARTIES

This shipping policy applies between Stanfield, SASU, with a share capital of €1000, registered with the RCS of Paris (75001) on 01/03/2024 under number 985143783. The company's head office is located at 229 Rue Saint-Honoré, 75001 Paris, FR, and can be contacted via phone at +33184603424 or email at contact@fabelt.com. The VAT number associated with the company is FR53985143783. Hereinafter referred to as “the Publisher,” the party responsible for managing product shipments. This policy also governs the relationship with any private or public individual or entity registered on the Site intending to purchase a Product, hereafter referred to as “the Client.”

ARTICLE 3. DEFINITIONS

“Client”: Refers to any private or public individual or entity registered on the Site, committed to adhering to the policies herein to ensure a seamless purchasing process.

“Site Content”: Encompasses all elements published on the Site, including texts, images, designs, videos, diagrams, structures, databases, or software, whether protected by intellectual property rights or not. These elements are provided to inform, assist, and enhance the user experience in accordance with legal standards.

“The Publisher”: Stanfield, SASU, acting in its capacity as the owner and operator of the Site, responsible for overseeing content management, user interactions, and shipping procedures.

“Internet User”: Any individual or entity accessing or navigating the Site, acknowledging that their usage of the platform implies acceptance of the terms outlined in this shipping policy.

“Product”: Any good offered for sale on the Site by the Publisher, encompassing a wide range of items, and subject to specific shipping terms and conditions tailored to each product type.

“Site”: The online platform accessible via the URL Fabelt.com, including all associated sub-sites, mirror sites, portals, and related URLs, providing a comprehensive environment for shopping activities.

ARTICLE 4. SCOPE

The Site is freely accessible to any Internet User. By browsing the Site, the Internet User acknowledges and accepts the application of this shipping policy, which governs the entire transaction process. Connection to the Site, whether via automated tools such as robots or standard browsers, constitutes full acceptance of the described shipping terms, emphasizing the importance of understanding and agreeing to these policies before proceeding with purchases. The act of registration further confirms the Internet User’s acknowledgment and acceptance. Ticking the acceptance box during registration or checkout is legally considered equivalent to a handwritten signature, with the same evidentiary value under applicable law. The Publisher's automatic recording systems serve as admissible evidence of consent and transaction details, unless proven otherwise, waiving the right to contest their validity in case of dispute.

This shipping policy exclusively governs the relationship between the Publisher and the Client. It supersedes any other contractual provisions or website policies that might conflict, ensuring clarity and uniformity. For the validity of acceptance, the Internet User must possess the necessary legal capacity, such as being of legal age or having appropriate authorization from guardians, or acting within their legal authority if representing a minor or a legal entity. These measures safeguard both parties and help maintain a trustworthy shopping environment.

ARTICLE 5. DELIVERY

5.1. Shipping Fees

Shipping or delivery fees will be transparently communicated to the Client prior to payment. Fees listed on the Site cover deliveries within mainland France, including Corsica, providing clear information for the customer to make informed decisions. For deliveries outside this geographical area, the Client is encouraged to contact customer service to obtain precise information about additional costs and possible restrictions. When products are delivered in-store or at a Partner location, specific fees are communicated at the time of the order, ensuring complete transparency. All shipping fees are displayed in euros and include applicable taxes, reflecting the total cost the Client will incur, contributing to an honest and straightforward purchase experience.

5.2. Delivery Time

Orders are shipped via reputable carriers such as La Poste, DPD, Chronopost, Mondial Relay, Geodis, DHL, FedEx, UPS, EMS, and are generally delivered within 14 to 45 working days from the full receipt of payment by the Publisher. Delivery times may vary depending on the destination and product availability. Certain items or higher-volume orders may require longer processing times, which will be explicitly communicated to the Client at the time of order confirmation. This ensures the Internet User acknowledges the potential for extended delivery periods and allows for better planning and expectations management.

5.3. Damaged Package

In cases where the package appears visibly damaged upon receipt, the Client is advised to refuse acceptance. This step is necessary to benefit from the carrier’s guarantee for damages incurred during transit. The Client must immediately notify the seller to initiate the process of preparing and dispatching a replacement product once the damaged package is returned. Significantly, in such instances, the standard delivery timelines outlined above no longer apply until the issue is resolved, ensuring prompt resolution and safeguarding the Client’s interests.

5.4. Retention of Title – Transfer of Risk

Ownership of Products remains with the Publisher until full delivery and payment are completed, unless explicitly waived in writing by both parties. During this period, risk passes to the Client from the moment of order placement; hence, the Client bears responsibility for insuring the Products against damages or loss at their own expense. Proof of insurance must be provided upon first request by the Publisher, ensuring accountability and protecting both parties’ interests in case of unforeseen events.
