Fabelt Return Policy and Consumer Code Compliance Under Civil Code

ARTICLE 1. PARTIES

The term “the Publisher” refers to Stanfield, SASU. This agreement applies to any private or public individual or entity registered on the Site who intends to purchase a Product, hereinafter referred to as “the Client.” The policy defines the rights, obligations, and procedures applicable to all interactions involving the purchase and potential return of Products through this online platform.

ARTICLE 2. DEFINITIONS

“Client”: Any individual or entity, whether private or public, registered on the Site, engaging in transactions with the Publisher.

“Site Content”: All elements published on the Site including texts, images, designs, presentations, videos, diagrams, databases, and software. This content may be protected by intellectual property rights, and its use is subject to restrictions outlined herein.

“The Publisher”: The legal entity Stanfield, SASU, responsible for publishing and managing the Site, ensuring the accuracy, security, and accessibility of its content and services.

“Internet User”: Any individual or organization accessing the Site for browsing, informational purposes, or transactions.

“Product”: Any goods offered for sale by the Publisher on the Site, encompassing physical or digital items, governed by the applicable return policy and warranty conditions.

“Site”: The online platform accessible via the URL fabelt.com, along with its sub-sites, mirror sites, portals, and related URLs, facilitating seamless navigation and customer transactions.

ARTICLE 3. SCOPE

Access to the Site is freely available to any Internet User. By browsing, users acknowledge and accept these general conditions, which form the legal foundation of their interaction with the Site and its services. Connection to the Site, regardless of the method used, constitutes full acceptance of these terms, including the privacy and return policies.

Registration on the Site confirms acceptance, which is deemed equivalent to a handwritten signature under applicable French law. The Publisher’s automated recording systems hold evidential value, and unless challenged, such records serve as proof of the transaction and acceptances therefore. These terms constitute the exclusive contractual framework between the parties, overriding any other prior or conflicting conditions.

Acceptance of these terms presumes that Internet Users are legally capable of binding themselves to contractual obligations, or that they possess appropriate authorizations if acting on behalf of minors, incapacitated persons, or legal entities.

ARTICLE 4. PURPOSE OF THE SITE

The primary purpose of the Site is to facilitate the sale of Products to Clients. It provides an online marketplace designed to offer clarity, transparency, and security in transactions, aligning with consumer protection standards outlined in the consumer code.

ARTICLE 5. ORDER PROCESS

Ordering begins with the selection of one or more Products, which are then added to the virtual cart. The availability status of each Product is clearly indicated, ensuring clients can make informed purchasing decisions. Upon completing their selection, users proceed to review their cart by clicking a designated button, verifying product details, quantities, and prices before final confirmation.

During validation, clients review their selections and delivery information, with the option to modify or remove items prior to confirming the order. Successful validation directs the user to either log in using existing credentials or provide necessary personal details through the registration process. This ensures secure handling of user data and compliance with relevant privacy regulations.

Payment follows, with options including Paypal, Stripe, and Google Pay, offering secure, encrypted channels safeguarding client financial data. Payment data related to credit card transactions are not accessible to the Publisher, aligning with banking security standards. For other payment methods like checks or bank transfers, delivery is only initiated once funds are confirmed received, adhering to standard financial procedures.

A confirmation email, summarizing the order details and processing status, is dispatched within 24 hours of successful payment, reinforcing transparency and traceability—key features valued by customers seeking reliable online shopping experiences.

ARTICLE 6. PRICES AND PAYMENT

Prices displayed on the Site are those current at the time of the order and are subject to change without prior notice, reflecting market fluctuations and operational adjustments. All prices are inclusive of taxes, consistent with European and French legal standards, but exclude shipping or delivery fees, which are calculated separately during the checkout process.

The Payment Methods section details accepted options, featuring trusted international providers ensuring the security of transaction data. The confidentiality of credit card details is maintained in compliance with GDPR and PCI DSS standards, providing clients with peace of mind when completing their purchases.

Invoices are issued electronically following each completed payment and are accessible through a user’s account. Clients expressly consent to receiving electronic invoices, which optimize transaction tracking, facilitate record keeping, and promote environmental sustainability.

In cases where payment deadlines are missed, late payment penalties apply automatically, calculated at a rate three times the legal interest rate, as mandated by French law. Additional collection costs of €40 are imposed, along with a 20% penalty on unpaid amounts, which protect the financial interests of the Publisher while maintaining fairness for clients.

Ownership of Products remains with the Publisher until full remuneration is received, in accordance with the retention of ownership clause, ensuring contractual security and aligning with legal principles under the civil code.

ARTICLE 7. COMPLAINTS - WITHDRAWAL - WARRANTY

Customer service is available during standard business hours, providing clients with assistance, clarifications, and support for their purchases. The service team can be reached via dedicated phone number, email, or postal mail, with responses guaranteed within 48 hours, promoting customer satisfaction and trust.

The right of withdrawal grants consumers a 14-day period to reconsider their purchase without justified cause, provided the conditions established by the consumer code are met. This statutory right applies primarily to consumer Clients purchasing for personal use, affording them a valuable safeguard in remote transactions. The withdrawal period commences upon receipt of goods or completion of digital services, with extensions applied for weekends and public holidays to ensure fairness.
